If found to be infringing then the drive roms were registered in the US prior, so damages and costs could be awarded. So I hope that Jim has had discussions with them and been given permission. I would be interested in seeing an actual contract from commodore giving permission that explicitly said it was transferrable as that could also affect real drives too. It was probably done on a nod and a handshake though, which wouldn't generally be transferable. It would be a defence if you personally got sued, but you can't really sell that.
