That helps your case when reimplementing code. It's not like patents 
where you don't even need to know there is a patent to infringe, with 
copyright you need to have copied it.

So if you end up with some of the same sequences then you can argue that 
it's just a coincidence. Obviously if you ended up with the entire 
contents of the ROM then you copied it & you don't have much of an argument.

It would be possible to do a legal jiffy dos compatible kernal, but it's 
far easier to just pirate it.
